Terms of Service
Summary: These Terms of Service govern your use of Fetchr's delivery platform. By using our services, you agree to these terms. Please read them carefully before placing any delivery orders or creating an account.
1. Acceptance of Terms
By accessing or using the Fetchr platform (“Platform”), including our website, mobile applications, and delivery services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our services.
These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Fetchr Technologies (Pvt) Ltd (“Fetchr,” “we,” “us,” or “our”), a company registered under the laws of Zimbabwe with its principal office in Harare.
You must be at least 18 years of age or the age of majority in your jurisdiction to use our services. By creating an account, you represent and warrant that you meet this age requirement.
2. Definitions
- “Sender” refers to the individual or business entity initiating a delivery through the Platform.
- “Recipient” refers to the intended receiver of a delivery.
- “Courier” or “Rider” refers to an independent contractor who fulfills delivery requests through the Platform.
- “Delivery” refers to the transportation of a package or item from a pickup location to a drop-off location arranged through the Platform.
- “Service Area” refers to the geographic regions where Fetchr operates, currently focused on Harare, Zimbabwe and surrounding areas.
- “Platform” refers collectively to the Fetchr website, mobile applications, APIs, and all related services.
3. Service Description
Fetchr operates an on-demand delivery platform that connects Senders with independent Couriers. We provide the technology infrastructure that enables Senders to request deliveries and Couriers to fulfill those requests. Fetchr is a technology platform and logistics coordinator — Couriers are independent contractors, not employees of Fetchr.
3.1 Delivery Options
We offer multiple delivery tiers including Express (under 60 minutes), Standard (2–4 hours), and Scheduled deliveries. Availability of specific delivery options depends on your location within our Service Area, courier availability, and prevailing conditions.
3.2 Service Availability
While we strive to maintain continuous service availability, we do not guarantee uninterrupted access to the Platform. Service may be temporarily unavailable due to maintenance, system updates, adverse weather conditions, or circumstances beyond our reasonable control.
4. User Accounts
4.1 Registration
To use certain features of the Platform, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.2 Business Accounts
Business users may register for corporate accounts with additional features including volume pricing, API access, multi-user management, and dedicated support. Business accounts are subject to additional terms as specified in your service agreement.
4.3 Account Security
You must immediately notify Fetchr of any unauthorized use of your account or any other breach of security. Fetchr shall not be liable for any loss arising from your failure to protect your account credentials.
5. Delivery Terms
5.1 Booking a Delivery
When you request a delivery, you must provide accurate pickup and drop-off locations within our Service Area, a description of the package contents, the appropriate package size category, and any special handling instructions. Providing false or misleading information may result in cancellation of your delivery and suspension of your account.
5.2 Pickup & Handoff
You must ensure that the package is ready for pickup at the designated location and time. If a Courier arrives and is unable to collect the package within the designated waiting period (typically 10 minutes), the delivery may be cancelled and a cancellation fee may apply.
5.3 Delivery Confirmation
Deliveries are confirmed via the Platform when the Recipient acknowledges receipt. In cases where the Recipient is unavailable, the Courier may leave the package at the designated location if instructed to do so by the Sender, at the Sender's risk.
5.4 Estimated Delivery Times
Delivery time estimates are approximate and not guaranteed. Actual delivery times may vary based on traffic conditions, weather, courier availability, and other factors. Fetchr shall not be liable for delays caused by circumstances beyond our reasonable control.
6. Pricing & Payment
6.1 Pricing
Delivery fees are calculated based on distance, package size, delivery speed, and current demand. The total price is displayed before you confirm your booking. Prices are quoted in United States Dollars (USD) or the applicable local currency and include applicable taxes unless otherwise stated.
6.2 Payment Methods
We accept various payment methods including mobile money (EcoCash, OneMoney), bank transfers, credit/debit cards, and cash on delivery where available. Payment is due at the time of booking unless you have an approved corporate billing arrangement.
6.3 Refunds & Cancellations
If you cancel a delivery before a Courier has been assigned, you will receive a full refund. Cancellations after Courier assignment may incur a cancellation fee. Refund requests for completed deliveries due to service issues will be evaluated on a case-by-case basis.
7. Prohibited Items
The following items are strictly prohibited from delivery through the Fetchr Platform:
- Illegal drugs, narcotics, or controlled substances
- Firearms, ammunition, explosives, or weapons of any kind
- Hazardous materials, chemicals, or flammable substances
- Counterfeit or stolen goods
- Live animals
- Perishable goods requiring temperature-controlled environments (unless using our approved cold-chain service)
- Human remains or body parts
- Currency, bearer instruments, or negotiable securities exceeding USD 500 in value
- Items that violate any applicable Zimbabwean law or regulation
Fetchr reserves the right to refuse, inspect, or return any package suspected of containing prohibited items. Senders assume full liability for damages or legal consequences arising from shipping prohibited items.
8. Liability & Insurance
8.1 Package Insurance
All deliveries include basic coverage of up to USD 50 per package for loss or damage. Additional insurance coverage may be purchased at the time of booking for higher-value items. Claims must be filed within 48 hours of the delivery or expected delivery date.
8.2 Limitation of Liability
To the maximum extent permitted by Zimbabwean law, Fetchr's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the greater of (a) the fees paid by you in the three (3) months preceding the claim, or (b) USD 100.
8.3 Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. Fetchr does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
9. Intellectual Property
All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, software, and the Fetchr name and trademarks — are the exclusive property of Fetchr Technologies (Pvt) Ltd and are protected by Zimbabwean and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.
10. Termination
We may suspend or terminate your account and access to the Platform at any time, with or without cause, including but not limited to violation of these Terms, fraudulent activity, abusive behaviour toward Couriers or support staff, or non-payment of fees. Upon termination, your right to use the Platform ceases immediately, though provisions that by their nature should survive termination shall remain in effect.
You may close your account at any time by contacting our support team. Account closure does not relieve you of any outstanding payment obligations.
11. Dispute Resolution
Any disputes arising out of or relating to these Terms shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to mediation administered by the Arbitration Centre of Zimbabwe.
If mediation is unsuccessful, the dispute shall be resolved by binding arbitration in accordance with the Arbitration Act [Chapter 7:15] of Zimbabwe. The arbitration shall be conducted in Harare, in the English language.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Zimbabwe, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Zimbabwe for the resolution of any disputes not subject to arbitration.
13. Changes to Terms
Fetchr reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email at least fourteen (14) days before they take effect. Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the revised Terms.
